During the summer that just passed, I had an amp provider in my area (SE PA) ask me if I would consider marrying her so that she might obtain a green card. She offered cash compensation. Very sweet girl but that is not an arrangement that I would be willing to enter into.

Smart move. If you find someone you really want to marry, it may be complicated to get out of your paper marriage.

This is not uncommon at all.
The compensation can be pretty good ($30-50k)
Many/most of them just look at it like a business arrangement, and often don't understand when you refuse.
I have a lawyer friend who used to work in immigration law. Over the past several years, authorities have made these arrangements far riskier. Used to be you could go your own separate ways after completing the marriage thing. Now they check back with you after two years or so, and if you have both moved on and the sham nature of the marriage is evident, both parties can suffer substantial penalties and/or jail time.

Excellent warning! What if the it was only a sham marriage for the foreign wife, but not the American husband?
Probably good to include these details in the prenup. I hope it can cover this.

The going rate the last time I heard for a green card is ~75k a MMS joked I shouldn’t take less I’ll be stuck for a couple of years. But I am not here to rescue anyone and neither overseas. Save yourself the years of headache and paperwork and keep it as a fling. You’re there for vacation, a good time not a long time. Remember that.

Especially if you’re paying for a girl overseas and then think about marrying her and giving her a green card. That’s a win win situation for her and shows her dominance over you. We have the money, we have the US citizenship, so we need to hold the power and just have a good time and not fall for the dreams they’re selling.

A prenup would be an excellent idea, and many of the more honorable wife candidates will lead with this.
A sham marriage would be a sham marriage for both parties if it is proven that both parties knew it would be a sham, such as when a payment was involved.
In the past, they would only go after the foreign wife (or foreign husband), but now they go after both the American and the foreign members of the marriage.
It seems like the authorities realized that also penalizing the American half of the "marriage" exerted a stronger inhibitory effect.
Since the sham nature of the marriage is the illegal part, any provisions to that effect in a legal contract would render the contract unenforceable.

If the sham part is the foreign wife lying about her love to the American husband who thought the marriage was legitimate, is the lying foreign wife liable? In this case, the husband is a fool for love, not a knowing part of a sham marriage.
