Isn’t that the responsibility of the owner of the building. I’m assuming the spa is renting the space.
In a commercial lease the business that leases the space has the responsibility to be correctly licensed and inspected to provide the products or services it claims to offer. So it's not on the landlord but on the renters.

In the case of a residential property since the only supposed use is to live there, the responsibility is on the landlord (or the builder if it's still new and under warranty).
