Yup…AFTER. You arrested…AFTER you make bail…AFTER your mug shot is posted online….AFTER. AFTER…AFTER.
They are probably willing to lose a few cases…. At the expense of making a number of arrests .
But at the same time; that kind of proves that this bill means nothing in a sense. Whether it’s class abcdef or whatever; if they want to make an example of you; your ass is caught. The bigger concern is stepped up enforcement; which also seems to be a thing.

You can sue for false arrest-----assuming that you just shut the F up during the arrest don't bury yourself. I agree that police probably cut a lot of corners on these raids because most arrestees are just gonna look to cut a deal for administrative adjudication of the case or maybe they will bury themselves trying to explain their way out of the arrest. All of the defendants in the Kraft case benefited from the money he had to put into fighting the case and the exposure of the shortcuts taken.

So, it ups the ante to a class F or class D felony if it is a repeat offense within 5 years, if the woman is under 18, or if the act occurs "...within 1,000 feet of any school, residence, church, synagogue, or other place of worship..."
Dang! Is Delaware turning into Texas?
mass incarceration. everything is a crime, every crime is a felony

can anyone think of even one AMP at least in N. Wilmington that isn’t within a 1000ft of a residence? Damn. It may only incur a fine, but a felony can have serious repercussions on your professional and personal life. Be careful out there boys

Very scary indeed. Philly and South Jersey will be my destination from.now on, I suppose.
