can a spa get you in trouble if you call to ask if their open? Idk why but I feel rather paranoid after calling a place and the owner texted back saying “ not open “

No, it doesn't hurt to ask, especially right now with most places starting to reopen. The list of who is and who isn't open is still up in the air. Just don't be annoying about it, call up or text once. Don't be like some people and repeatedly call or text, trying to find out. More than likely everyone else is probably doing the same, so whoever operates the phone may be swarmed.
