Here is the legal template I use that an attorney friend gave me some 25 years ago. Works for most situations and certainly will work if you get caught up in some spa drama : "Officer, I am happy to answer your questions but I have no statement to make at this time. I would be happy to make a statement when my attorney is present. Am I free to go?"
Repeat until your face turns blue. If they ask a hundred questions repeat verbatim a hundred times. Answer zero questions other than providing your ID. In this way you are being respectful and providing no statement. You are also politely putting the cops on notice that they cannot hold you against your will...arrest me or let me go, i am not answering questions is implied by the template . Mistake one is people get scared and divulge information that gets them into trouble. Mistake two is getting smirky or overconfident, pissing off the police who may be motivated to nail you with anything.
Staying silent and getting out of there in a respectful way is always the answer , but the police are good at soliciting information by asking seemingly harmless questions that are actually you making statements... before you know it you have implicated yourself. That is why I was advised to memorize the above template. Hope that helps. Also, have an artorney in mind to call in case they do call your bluff, even if that attorney is Tim Misny. Be safe. Be smart.
